By accessing and using the platform and services provided by Nemu ("Nemu," "Company"), you agree to be bound by these Terms of Use. If you do not agree, you must refrain from using the platform.
2. About Nemu
Nemu is a technology company operating from Palo Alto, California (PST), providing software solutions and services for digital marketing optimization and related functionalities.
3. Purpose and License
3.1. These Terms govern the grant of a revocable, non-exclusive, non-transferable license to use Nemu’s digital platform, which provides marketing campaign management, optimization, and related functionalities.
3.2. Use of the platform is subject to these Terms, as well as Nemu’s Privacy Policy and Cookie Policy, available on the website/platform.
4. Platform and Services
4.1. Nemu provides a SaaS platform that enables campaign management, data analytics, and other tools to optimize digital strategies.
4.2. The platform relies on integrations with third-party services (e.g., social networks, payment gateways, APIs). Nemu is not responsible for failures caused by such third-party systems.
4.3. The platform is available 24/7, except during maintenance, updates, security incidents, or force majeure, with prior notice when reasonably possible.
5. Technical Support
5.1. Technical support is available during business hours, 7 days a week, from 9 a.m. to 6 p.m. (PST), through the support channels indicated on the platform.
5.2. Nemu will make reasonable efforts to resolve technical issues but does not guarantee immediate or absolute resolution in all cases.
6. Plans, Payments, and Cancellations
6.1. Users may subscribe to different plans, each with specific features and limits.
6.2. Pricing, payment methods, and billing terms will be provided at the time of subscription.
6.3. Subscriptions renew automatically unless canceled by the User at least 2 business days before the renewal date.
6.4. In case of non-payment, Nemu may suspend or terminate access according to its policies.
7. User Obligations
7.1. Maintain the security of login credentials and notify Nemu of any unauthorized use.
7.2. Use the platform only for lawful purposes and in compliance with these Terms.
7.3. Refrain from actions that compromise the security, integrity, or performance of the platform.
8. PIntellectual Property
8.1. Nemu retains all intellectual property rights to the platform and its content.
8.2. The User is granted only a limited license to use the platform. Transfer, assignment, or sublicensing is prohibited.
9. Confidentiality and Data Protection
9.1. Both parties agree to maintain confidentiality of all information exchanged during the relationship.
9.2. Processing of personal data is governed by Nemu’s Privacy Policy, in accordance with applicable U.S. and international data protection laws (such as CCPA and GDPR, when applicable).
10. Limitation of Liability
10.1. Nemu shall not be liable for indirect damages, loss of profits, or damages caused by the use or unavailability of the platform.
10.2. Nemu is not responsible for failures of third-party integrations or misuse by the User.
11. Term and Termination
11.1. These Terms remain in effect while the User accesses the platform.
11.2. Users may cancel their subscription according to the conditions disclosed.
11.3. Nemu may suspend or terminate access in case of breach of these Terms, with prior notice.
12. Governing Law and Jurisdiction
12.1. These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions.
12.2. Any disputes shall be resolved exclusively in the courts located in Santa Clara County, California, United States.
